We present below the Terms and Conditions of Use ("Terms"), a document that lists the main rules that must be observed by those who access ArcelorMittal Brazil’s Website or use its features, in this case, the User.

As a condition to access and use the Website's features, the User declares that he/she has completely and carefully read the rules of this document, being fully aware and in accordance with them.

1. SITE FEATURES

1.1. Features. ArcelorMittal Brazil’s website, registered under the domain https://brasil.arcelormittal.com/ has the following features and information:

  • Institutional information about ArcelorMittal Brazil and its units; Products and Solutions;
  • Certificates and Policies;
  • Logistics services and targeting to external pages of Customers, Employees and Partners, Suppliers and Carriers;
  • Information on sustainability, governance, environment, social investment and health and safety;
  • People: information on development, corporate education, compensation, attraction and selection of new employees;
  • Press room: place for journalists to register and receive content about ArcelorMittal

1.2. Majority. Access and use of the Website is free for everyone, however some features, such as registration in certain environments, may require acts practiced by people over 18 (eighteen) years old, according to the legislation in force.

1.2.1. In these cases, legal representatives must supervise and represent children and adolescents under 16 (sixteen) years old and assist adolescents older than 16 (sixteen) and under 18 (eighteen) years old, whenever applicable.

1.2.2. ArcelorMittal Brazil may refuse, disapprove, cancel or limit any requests, if the User does not provide correct data.

1.2.3. The same will apply when using the Website, if it is used in a fraudulent manner, and if attempting or violating these Terms or any applicable laws.

1.3. Eligibility. ArcelorMittal Brazil may change the eligibility criteria to access and use the Website at any time and at its discretion, not needing to communicate or give prior notice to the User or any third party.

1.4. Emails. By providing data on the Website, the User agrees that he/she may receive messages with notices and advertising content of ArcelorMittal Brazil’s products and services and from its partners. The User will be able to choose in his/her own email, or through the instructions included in the Website, to no longer receive such communications.

1.5. Presentation of the Website. The Website and its features are presented to the User as they are available, and may undergo constant enhancements and updates.

1.5.1. In this case, ArcelorMittal Brazil commits to preserve the Website functionalities with reasonable efforts, with unbroken Links and using a layout that respects usability and navigability, whenever possible, as well as showing the features in a clear, complete, accurate and sufficient manner so that there is a correct perception of what is being done.

2. USE OF THE WEBSITE

2.1. Secrecy of Access Account data. The User must keep the confidentiality of his/her Access Account data and use it in an individual and non-transferable manner, not making available, disclosing or sharing his/her password or any authentication mechanism with anyone. If the User suspects that the confidentiality of his/her password has been breached, the User must change or update it as soon as possible. The User is aware and acknowledges that all accesses and operations performed after his/her successful digital authentication are undeniably interpreted as his/her responsibility, including those derived from misuse or disclosure to third parties.

2.2. Website Integrity. The User commits to not access programming areas of the Website, its database, source codes or any other data available in these environments, and also not to perform or allow reverse engineering, nor to translate, decompile, copy, modify, reproduce, rent, sublicense, publish, disclose, transmit, loan, distribute or otherwise improperly dispose of the Website's functionalities.

2.3. No data mining. It is forbidden to use any kind of data mining software or any other similar software to mine data from the Website.

2.4. Indemnity. In the event of violation by the User of any provisions included in this Term, the User shall indemnify ArcelorMittal Brazil, its Affiliates and/or Representatives, in addition to third parties who may be harmed, as the case may be, for all losses, damages, including moral or competition issues, expenses or other charges caused by such breach, including, but not limited to, attorney's fees and court costs incurred as a result of the aforementioned breach.

3. CONTENT, SUBMITTED DATA AND INTELLECTUAL PROPERTY

3.1. Content. Unless otherwise provided by these Terms, all information, news, images, brands and market information ("Content") made available on the Website in any language or form, is either ArcelorMittal Brazil’s exclusive property or licensed to ArcelorMittal Brazil. The use of the Website by the User does not presume transfer of that property or license. For this reason, the User must not trade the Content in whole or in part, by any means, whether onerous or not, knowing that if he/she does so, he/she may be penalized civilly and criminally by ArcelorMittal Brazil and/or by any third party owner of the Content.

3.1.1. The eventual deletion, blocking or suspension of any Content or functionality of the Website as a result of any complaint, should always be understood as a demonstration of good faith and intention to amicably solve conflicts, never as recognition of guilt or of any infraction by ArcelorMittal Brazil to a third party right.

3.2. User data. The User is and will continue to be the holder and owner of all data, information, text, images, messages, videos, audios, charts or any other material in any way submitted and/or shared on the Website by the User ("User Data"), and will be exclusively responsible for them, being the User solely responsible for respecting the intellectual property of third parties or any other related rights.

3.3. Legality of User Data. ArcelorMittal Brazil shall not be obliged to process or handle any of the User Data if there are reasons to believe that such processing or handling may imply to ArcelorMittal Brazil any breach of any applicable law or that the Website is being used, under ArcelorMittal Brazil 's sole discretion, for any purposes considered as illegal, unlawful or contrary to morality.

3.4. No warranties regarding User Data and Content. The User is responsible for providing full data and to check the source of the Content or of the User Data. Therefore, ArcelorMittal Brazil is not responsible for any inaccuracy, outdated data or error of this Content or of the User Data, nor is it responsible in any way for any damages arising from this Content. ArcelorMittal Brazil is solely responsible for ensuring that the User, through a request, is able to correct his/her data in case of being incomplete, inaccurate or outdated.

3.4.1. Without prejudice to the above provisions, the User is aware and agrees that ArcelorMittal Brazil has no actual or presumed obligation to publish any Content or User Data, and may remove such Content or User Data with or without prior notice.

3.4.2. Under no circumstances, the User shall make any decision, whether onerous or not, entirely based on the Website Content or any of its functionality.

3.5. Storage. ArcelorMittal Brazil does not provide storage services and the Website does not constitute a storage service. Therefore, ArcelorMittal Brazil has no obligation to store, retain or provide the User or any third party with a copy of User Data or any Content, unless required by law in terms of form or type of the data handled.

3.6. Algorithmic intelligence. The Website, impersonally and automatically, may apply statistical models and algorithmic intelligence to index, filter and organize the Content or the User Data, generated or shared through the Website.

3.6.1. The User declares himself/herself aware that ArcelorMittal Brazil, if not at its sole discretion, will not disclose or provide the User or any third party with any systemic or algorithmic information related to the Website.

4. YOUR PRIVACY AND YOUR PERSONAL DATA

4.1. Personal data. If the User handles or conveys, within the scope of the Website, information related to an identified or identifiable natural person ("Personal Data"), the User will be solely responsible for collecting the necessary authorizations from the holder of the Personal Data.

4.1.1. ArcelorMittal Brazil will monitor, by appropriate means, its own compliance with the respective Personal Data protection obligations, if applicable.

4.2. Registering. ArcelorMittal Brazil may register all activities performed by the User on the Website, including identification data, device data and connection data ("Records").

4.3. Purpose of Collection. The Records may be used for the purpose of: (i) identifying the User and serving him/her (ii) complying with obligations of these Terms (iii) improving the Website; (iv) safeguarding rights and obligations related to the use of the Website; and (v) complying with a court order and/or administrative authority.

5. DISCLAIMER AND LIMITATIONS OF LIABILITY

5.1. ArcelorMittal Brazil endeavors to keep continuous and permanent availability of the Website. However, occasionally, there may be some temporary unavailability due to necessary maintenance or even due to force majeure, such as natural disasters, failures in communication systems and Internet access, invasive cyber-attacks, or any third-party facts that are out of scope of ArcelorMittal Brazil’s surveillance and responsibility.

5.1.1. If that happens, ArcelorMittal Brazil will do everything in its power to restore access to the Website as soon as possible, within the technical limitations of its services and third-party services, which it depends on to remain online. For this reason, the User should be aware that he/she will not be able to claim indemnity or damage repair in case the Website remains offline, regardless of the reason.

5.1.2. Any maintenance procedures that cause the Website to be unavailable for long periods will be informed through the ArcelorMittal Brazil official communication channels.

5.2. Without prejudice to other conditions of these Terms, ArcelorMittal Brazil shall not be held responsible for:

i. any problems, bugs, glitches or improper functioning that occur on devices and equipment;

ii. Any direct or indirect damage caused by third party events; for example, but not limited to, hacker attacks, system, server or internet connection failures, including software actions that may, in some way, damage physical or logical assets as a result of accessing, using or browsing the Website, and of transferring data, files, images, texts, audios or videos included in the Website;

iii. Navigating on any external links made available on the Website, being its duty to read the Terms and Conditions of Use and the Privacy Policy of the feature accessed and acting as determined; and

iv. Verifying, controlling, approving or guaranteeing the adequacy or accuracy of the information or data made available on such links, not being, therefore, responsible for harms, losses or damages caused by the visit to such websites; it is up to the interested party to check the reliability of the information and data displayed there before making any decision or performing any act.

6. OTHER PROVISIONS

6.1. Service Channels. The User may use the Service Channel "Contact Us" on the Corporate Website, on https://brasil.arcelormittal.com/contato, every time he/she witnesses or verifies inappropriate content on the Website, whether it is notoriously illegal or contrary to the rules of use stipulated in these Terms.

6.2. Update of Terms. These Terms are subject to constant improvement. Thus, ArcelorMittal Brazil reserves itself the right to modify them at any time, according to its purpose or convenience, and for adequacy and legal compliance with laws or rules with equivalent legal force, including regulatory agencies, i.e., the User should check them whenever accessing the Website.

6.2.1. In the event of updates to these Terms, ArcelorMittal Brazil will notify the User through the tools available on the Website or via contact means informed by the User.

6.2.2. When browsing the Website and using its features, the User agrees to be guided by the Terms in force on the date of access. For this reason, the User should be aware of the current conditions.

6.3. Novation and resignation. Tolerance of eventual breach of any conditions of these Terms will not constitute a waiver or novation nor will it prevent ArcelorMittal Brazil from demanding these conditions at any time.

6.4. Nullity. If any provision of these Terms is found to be inapplicable or ineffective, the remaining provisions will continue to apply normally.

6.5. Communication. The User acknowledges that all communication via e-mail (to the e-mail address informed in his/her registration) is valid, effective and sufficient for the disclosure of any Website-related matter.

6.6. Date and time. The Website is based on the official date/time of Brasília (UTC/GMT -03:00).

6.7. Applicable law and forum. These Terms will be interpreted in accordance with Brazilian law, in the Portuguese language, and the jurisdiction of the District Court of Belo Horizonte, Minas Gerais state, will be appointed to settle any dispute, unless the applicable legislation specifically reserves other personal, territorial or functional jurisdiction.

v. Access Account: Credential that allows access to the restricted area and to the exclusive features of the Website.
